Welcome to Rosy Ridge. These Terms of Service ("Terms") govern your use of our website and your purchase of any product from us. By browsing this site or placing an order, you agree to these Terms. If you don't agree with them, please don't use the site.

Please read Section 3 carefully. It concerns your health.

1. Who we are

This website is operated by Rosy Ridge ("Rosy Ridge", "we", "us", "our"). Throughout the site, the terms "you" and "your" refer to you, the user or customer.

2. Eligibility

You must be at least 18 years old to buy from this site. By ordering, you confirm that you are 18 or over and that the information you give us is accurate and complete.

3. Health, medical and product disclaimers

This is the most important section on this page.

Our products are dietary supplements, not medicines.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing on this site is medical advice. The content here — including product pages, articles, customer reviews, emails and advertising — is for general information only. It is not a substitute for professional medical advice, diagnosis or treatment, and it is not a consultation with a qualified healthcare provider.

Never stop or change a prescribed medication because of anything you read here. If a doctor has prescribed you something, keep taking it as prescribed. Our products are intended to be taken alongside whatever your healthcare provider has advised, never instead of it. Always speak to your doctor or pharmacist before starting any supplement, and particularly if you:

• take prescription or over-the-counter medication of any kind;
• have a diagnosed medical condition, or are being investigated for one;
• are pregnant, trying to conceive, or breastfeeding;
• have a scheduled surgery or medical procedure; or
• have any known allergy or sensitivity to fruit, plant extracts or capsule ingredients.

If you think you are having a medical emergency, call your local emergency number or go to your nearest emergency department. Do not delay seeking medical help because of anything you have read here.

Individual results vary. Supplements are not uniform in their effects. Any experience described on this site — in a review, a testimonial, or anywhere else — is that person's own and is not a promise, guarantee or prediction of what will happen for you.

Read the label. Always read the product label and Supplement Facts panel before use and follow the directions given there. Keep supplements out of reach of children. Do not use if any seal is broken or missing. Discontinue use and consult a healthcare provider if you experience any adverse reaction.

4. Products, descriptions and availability

We try to display our products, ingredients and packaging as accurately as we can. Screen colours vary, and product photography is illustrative — packaging and label design may be updated from time to time.

All products are subject to availability. We may change or discontinue any product at any time, and we may limit the quantity of any product we sell to any one person, household or order.

We reserve the right to refuse or cancel any order, for any lawful reason. Where we cancel an order you have already paid for, we refund it in full.

5. Pricing and errors

Prices are shown in the currency displayed at checkout and are subject to change without notice.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If a product's correct price is higher than the listed price, we will either contact you for instructions before shipping or cancel the order and refund you in full. We are not obliged to fulfil an order placed at an obviously incorrect price.

6. Promotions, discounts and offers

Promotional prices, bundles, discount codes and free-gift offers are available for a limited time and may be withdrawn or changed at any time. Unless we say otherwise, offers cannot be combined, have no cash value, and apply only to the products stated.

7. Orders and payment

Submitting an order is an offer to buy, not a completed contract. The contract is formed when we confirm that your order has been accepted and shipped.

You confirm that any payment method you use is yours, or that you have permission to use it. All payments are processed by our payment providers; we do not store your full card details.

8. Shipping and risk

Shipping is covered by our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery.

9. Refunds and our guarantee

Refunds are covered by our Refund Policy, which forms part of these Terms and sets out our 90-day money-back guarantee.

10. Reviews, testimonials and anything you submit

If you submit a review, photo, comment or any other content to us or to the site ("Submissions"):

• you confirm it is your own genuine experience, that you are who you say you are, and that you have not been paid or otherwise compensated for a review unless that has been clearly disclosed;
• you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, edit for length or clarity, publish and display it in any media, including in advertising, without payment or attribution;
• you agree it contains nothing unlawful, defamatory, obscene, misleading or infringing anyone else's rights.

We may publish, decline to publish, or remove any Submission at our discretion. We do not suppress reviews on the basis that they are negative, and we do not publish fake or incentivised reviews without disclosure. Any review we show is a real customer's own words.

Submissions are not confidential. Don't send us anything you wouldn't want made public.

11. Marketing communications

If you give us your email address or phone number, you may receive marketing messages from us. You can opt out at any time — use the unsubscribe link in any email, or reply STOP to any text message. Message and data rates may apply. Opting out of marketing does not stop transactional messages about an order you've placed.

12. Acceptable use

You agree not to use the site to do anything unlawful, to interfere with its operation or security, to scrape or harvest data from it, to resell our products without our written permission, or to impersonate anyone. We may suspend or refuse service to anyone who does.

13. Intellectual property

All content on this site — the Rosy Ridge name, logo, text, images, packaging design, graphics and page layouts — belongs to us or our licensors and is protected by intellectual property law. You may not copy, reproduce or use it commercially without our written permission.

14. Disclaimers and limitation of liability

The site and its content are provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. We do not warrant that the site will be uninterrupted, secure or error-free.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, and our total liability arising out of or connected with any order is limited to the amount you paid for that order.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In that case our liability is limited to the fullest extent permitted by the law that applies.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules.

Please contact us first. Most problems are solved by a single email, and we refund on request inside the guarantee window.

If we can't resolve it, you and Rosy Ridge agree that any dispute will be settled by binding individual arbitration rather than in court, and that each of us waives the right to a jury trial and to bring or join a class action. Arbitration will be administered under the rules of a recognised US arbitration body and seated in Wyoming or conducted remotely.

You can opt out of this arbitration clause. Email us within 30 days of your first order saying you wish to opt out, and it won't apply to you. Nothing else in these Terms changes if you do.

This section does not prevent either of us from bringing a claim in small-claims court, or from seeking an injunction to protect intellectual property.

16. Severability

If any part of these Terms is found unenforceable, the rest stays in force.

17. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. We'll update the "last updated" date whenever we change them.
